Legal
Terms
The agreement between your travel company and TripSetu. Short, and without the clauses that only exist to be unreadable.
What you are agreeing to
These terms are between Buildframe Technologies Private Limited (CIN U62099UW2026PTC259541, registered office C-1208, ACE Platinum, Sector Zeta-1, Greater Noida, Gautam Buddha Nagar, Uttar Pradesh 201306), which makes and runs TripSetu, and the company that opens an account, referred to here as “you”. Creating an account, or using the console, means you accept them. If you are agreeing on behalf of a company, you are confirming you are allowed to.
What TripSetu is, and what it is not
TripSetu is office software for a tour, travel or transport business: bookings and trip sheets, vehicles and their documents, drivers and their pay, invoices, receivables and per-vehicle profit and loss.
It is worth being just as clear about what it is not, because it changes who is responsible for what:
- We do not own, operate, dispatch or broker vehicles. We are not a taxi aggregator and we do not stand between you and your customer. The trip is your contract with your passenger, and any liability arising from it is yours.
- We are not an accounting package, a tax adviser or a filing service. The console prints GST invoices from the settings and rates you configure; whether those are correct, and whether your returns are filed, is yours to get right.
- There is no GPS hardware, no driver app and no public booking portal. Those are real products and each one is somebody else’s.
- We do not verify your drivers, their licences, your permits or your insurance. The console records what you enter and reminds you when a document is expiring. It cannot tell you that what you entered was true.
Your account
- Give your staff their own logins rather than sharing one. You are responsible for what is done under your account, and for keeping its passwords safe.
- Tell us promptly if you think someone has got into your account.
- Keep your contact details current. It is how we reach you about your account.
- Everything you enter must be data you are entitled to hold and use. Your customers’ and drivers’ details are yours to answer for; see the privacy page for how that split works.
Plans and payment
TripSetu is priced on the number of vehicles you dispatch, in bands, and every feature is in every band. A vehicle counts whether you own it, run it on attachment or lease it. Prices are in Indian rupees and shown on the pricing page; applicable taxes are extra.
- New accounts start on a 15-day free trial of the Starter band. We do not ask for a card to begin, so nothing can be charged by accident when it ends. We talk to you instead.
- Billing is monthly and there is no lock-in. You can stop at the end of a paid month.
- We invoice you and you pay the invoice. There is no card on file and nothing is auto-charged.
- Going over your band does not stop the console working. It tells you, you carry on, and we sort the plan out. Nobody who buys a cab on a Sunday should be unable to record it.
- If we change what a plan costs, we will tell existing customers before it applies to them.
- Fees already paid for a period are not refundable, except where the law says otherwise or where we have plainly got something wrong.
Your data stays yours
Everything you put into the console belongs to you. We hold it to run the service for you and for nothing else. We do not sell it, we do not share it with other operators, and we do not use it to train models. You can export it to a spreadsheet whenever you like, without asking.
If you close your account, ask us and we will delete your data within 30 days, keeping only what tax or other law requires us to. If you simply stop using the account, we will keep it as it is rather than quietly deleting your records.
Using it fairly
Do not use TripSetu to break the law, to store data you had no right to collect, to send anyone unsolicited messages, to attack or probe the service, to work around its limits or access controls, or to resell it as your own product. We can suspend an account that is doing any of those, and we will tell you why.
Availability, and what we do not promise
We work to keep TripSetu available and quick, and we will give notice of planned maintenance where we can. We do not offer a contractual uptime guarantee, and we would rather say so than publish a number we have not committed to. The service is provided as it is, without warranties beyond those the law gives you and does not allow us to exclude.
Keep your own records of anything your business cannot afford to lose. That is ordinary prudence with any software, ours included.
Liability
To the extent the law allows, neither side is liable to the other for indirect or consequential loss, or for lost profits, lost business or lost data. Our total liability for any claim is limited to what you paid us in the twelve months before it arose. Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.
Because we are not party to your trips, claims arising out of a journey, a vehicle, a driver or a passenger are between you and them. If such a claim is brought against us because of something you did, you will cover us for it.
Ending it
- You can stop at any time. Tell us, and the account closes at the end of the paid period.
- We can suspend or close an account for a serious or repeated breach of these terms, or for non-payment, with notice, and with a chance to put it right where that is reasonable.
- Either way, you can export your data before it is deleted, and you can ask us for it afterwards within the 30-day window above.
Changes to these terms
If we change these terms materially, we will email account holders and update the date on this page. Carrying on using the console after that means you accept the new version; if you would rather not, you can close the account.
Law
These terms are governed by the laws of India, and the courts at Greater Noida, Uttar Pradesh have exclusive jurisdiction over any dispute arising out of them.
Questions about any of this go to hello@buildframe.tech, and we would much rather answer one than have you guess.
